Description

The complaint alleges that Citizens for Better Schools Battle Ground (CBS BG), a local political committee registered with the PDC, violated RCW 42.17A.235 and .240 by failing to timely disclose contribution and expenditure activities undertaken by the committee in support of a November 8, 2016, Battle Ground School District bond measure, and a February 14, 2017 Battle Ground School District levy proposition.  The complaint alleged CBS BG failed to file or timely file Monetary Contributions reports (C-3 reports), and Summary Full Campaign Contribution and Expenditure reports (C-4 reports) disclosing contribution and expenditure activities.

PDC staff's assessment of the facts found that CBS BG failed to: (1) timely file C-3 reports in support of the November 8, 2016, bond measure on the general election ballot, and the February 14, 2017, levy election on the special election ballot, in violation of RCW 42.17A.235 and .240; and (2) timely file C-4 reports in support of the November 8, 2016, bond measure on the general election ballot, and the February 14, 2017, levy election on the special election ballot, all in violation of RCW 42.17A.235 and .240. 

CBS BG acknowledged the four violations of RCW 42.17A.235 and .240 listed above, and wanted to avoid the time and expense resulting from a Brief Adjudicative Proceeding (Brief Enforcement Hearing) being scheduled by PDC staff.

CBS BG completed a Statement of Understanding, and paid a $600 civil penalty, $150 each for the four acknowledged violations of RCW 42.17A.235 and .240, in accordance with the WAC 390-37-143 the Penalty Schedule for Brief Enforcement Hearings, in lieu of the PDC conducting a Brief Enforcement Hearing.
