Description

The Public Disclosure Commission (PDC) has completed its review of the complaint you filed on November 16, 2017. The complaint alleged that the Port of Tacoma, a public agency, may have violated RCW 42.17A.255 for failure to report independent expenditures in opposition to Tacoma Initiatives 5 and 6 in 2016; and RCW 42.17A.555 for misuse of public facilities to oppose Tacoma Initiatives 5 and 6 in 2016.

PDC staff reviewed the allegations; the applicable statutes, rules, and reporting requirements; and the Court of Appeals Division II opinion in case 49892-8-II, to determine whether the record supports a finding of one or more violations.

Based on our findings staff has determined that the Superior Court now has primary jurisdiction over the substance of this complaint, and the PDC will defer to its judgment in bringing the issues to resolution.

Based on this information, the PDC finds that no further action is warranted and has dismissed this matter in accordance with RCW 42.17A.755(1).
