Description

The Public Disclosure Commission (PDC) has completed its review of the complaint filed by Roger Lenk on July 5, 2018. The complaint alleged that Phillip Lemley may have violated RCW 42.17A.465 for an unauthorized loan transaction made without written agreement.

Based on our findings, staff has determined that in this instance, inaccurate loan reporting and failure to maintain a written agreement for loans of candidate personal funds does not amount to a finding of an actual material violation warranting further investigation.

Pursuant to WAC 390-37-060(1)(b), Phillip Lemley will receive a formal written warning concerning inaccurate loan reporting and failure to maintain a written agreement for loans of candidate personal funds. The formal written warning will include staff’s expectation that Phillip Lemley maintains proper books of account and properly reports all contribution and expenditure activity, including from candidate personal funds. The Commission will consider the formal written warning in deciding on further Commission action if there are future violations of PDC laws or rules.

The PDC has closed the matter,and will not be conducting a more formal investigation into the complaint or pursuing further enforcement action in this case.
