Description

The complaint alleged Friends For Newcastle violated RCW 42.17A.235 and .240 by failing to timely and accurately report contributions and expenditures on Monetary Contributions (C-3) and Full Summary Contributions and Expenditures (C-4) and RCW 42.17A.205 for failing to timely register as a committee.

According to the disclosure law, an organization becomes a political committee when it first has the expectation of receiving contributions or making expenditures in support of, or opposition to, any candidate or any ballot proposition.

There were three candidates for Newcastle City Council, Position. 7. With Friends For Newcastle supporting only two candidates, the group supported a candidate, plus made an expenditure of $15.

In the future, PDC staff expects Friends for Newcastle to register with the PDC if there is the expectation of receiving contributions or making expenditures in support of, or opposition to, any candidate or any ballot proposition.

Based on these findings, and the fact Friends For Newcastle was eligible for mini reporting, PDC staff has determined that, in this instance, the failure to timely and accurately report contributions and expenditures and register with the PDC does not amount to a violation warranting further investigation. 

PDC staff is reminding Friends For Newcastle about the importance of timely registering with the PDC and filing required reports in accordance with PDC laws and rules. 

Based on this information, the PDC finds that no further action is warranted and has dismissed this matter in accordance with RCW 42.17A.755(1).
