Description

The complaint alleged Burien for All may have violated RCW 42.17A.235 by failing to timely file reports of contributions and expenditures, RCW 42.17A.240 and WAC 390-16-037 by failing to provide detailed breakdowns of expenditures and RCW 42.17A.255 and RCW 42.17A.305 by failing to accurately and timely report independent expenditures and/or electioneering communications.

PDC staff reviewed the allegations; the applicable statutes, rules, and reporting requirements; the PDC reports filed by Burien for All and the response by Lynne Randall, committee treasurer, to determine whether the record supports a finding of one or more violations.

The alleged violations of RCW 42.17A.235 for failing to timely file reports of contributions and expenditures were addressed in PDC Case 27056 and will not be re-reviewed.

In September 2020, Burien for All filed a (C-6) report with the PDC, reporting the mailers to oppose Darla Green, Joel Manning, Debi Wagner and PattyJanssen. In response Randall stated “I think I understand now that this (C-6) is a completely separate form, containing the same info that Orca auto-fills to create C-4s, but is not connected to Orca at all. I did not understand this correctly and this is why it wasnot filed. It will contain the exact same information as the already-filedC-4s.”

Based on these findings, and the fact the mailings were timely reported on C-4 reports, staff has determined in this instance, the does not amount to an actual violation warranting further investigation.

PDC staff is reminding Burien for All about the importance accurately and timely filing all future PDC reports in accordance with the statutes and rules. Based on this information, the PDC finds that no further action is warranted and has dismissed this matter in accordance with RCW 42.17A.755(1).
