PDC staff reviewed the allegation(s); the applicable statutes and rules, and reporting requirements; the response(s) provided by the Respondent; the applicable PDC reports filed by the Respondent; and other relevant information, to determine whether the record supports a finding of one or more violations.
Based on staff’s review, we found the following:
Kevin Young filed a Candidate Registration (C-1) on April 24, 2024, for County Commissioner Position 3 in Pend Oreille County, under the Full Reporting option.
Kevin Young has a campaign website at https://www.votekevinyoung.com that at the time of the complaint did not include the required sponsor identification. PDC staff let Mr. know Young about sponsor identification requirements, and he updated the website to include all required elements for sponsor identification. As of June 12, 2024, the website is substantially compliant.
You filed a second complaint alleging missing and untimely campaign reporting. Staff investigated the allegation and found $2,275 in expenditures made and $4,198 in receipts received but unreported. The receipts include loans and in-kind contributions the candidate made to their own campaign. On July 8, 2024, Mr. Young submitted a Receipts & Expenditures Summary (C-4) for the period April 24, 2024, to July 31, 2024, and with this report his campaign is substantially compliant for reporting purposes.
On July 1, 2024, Mr. Young amended the C-1 to the Mini Reporting option. No approval was necessary for Mr. Young to convert his campaign from full reporting to mini reporting, but he must continue to not exceed the mini reporting thresholds to be compliant.
Mr. Young does not have other similar warnings or violations of PDC requirements.
Per WAC 390-37-060(1)(d), however, Kevin Young will receive a formal written warning concerning the requirement under RCW 42.17A.320 for failing to provide sponsor identification on political advertising; and RCWs 42.17A.235 and .240 for failing to timely and accurately report expenditures and contributions in the 2024 election. Staff expects Mr. Young, moving forward, to follow all statutes and rules for RCW 42.17A.320 and WACs 390-18-010 and 020, and RCWs 42.17A.235 and .240, and WACs 390-16-034 and 037. If violations of PDC statutes or rules occur in the future, the Commission will consider this formal written warning in deciding on further Commission action.
Based on this information, the PDC finds that no further action necessary and has dismissed this matter per RCW 42.17A.755(1).
