This complaint was filed with the Public Disclosure Commission (PDC) on March 26, 2018. The complaint alleged that that the Pacific County Democratic Central Committee, a Bona Fide Political Party Committee registered with the PDC, may have violated RCW 42.17A by failing to properly dissolve as a political party committee, preserve the committee's books of account, and to return excess contributions that exceeded the anonymous contribution limits.
PDC staff reviewed the allegations; the applicable statutes, rules, and reporting requirements; the applicable C-3 and C-4 reports filed by the Committee; and the response provided by the Committee.
Staff's review of the final C-4 report discovered that the Committee disclosed receiving $19,975 in total contributions, but made expenditures totaling $35,899, for a negative ($15,925) balance on line 18 of the report. Further review of the C-4 reports filed for 2017 found that the January 2017 report did not have a carryforward balance at the beginning cash on hand from 2016. Staff also discovered that the Committee had received an over limit anonymous contribution in the amount of $575 and asked the Committee to escheat this amount to the state. Staff also asked the treasurer to perform a reconciliation, which the treasurer did to the best of his ability based on the availble ORCA records and the Committee's bank records.
On December 21, 2018, the PDC received a check for $575 from the Committee for exceeeding the anonymous contribution limits, that was forwarded to the Department of Enterprise Services, a state agency that processes and handles small agencies collections, for deposit into the state General Fund in accordance with the statute.
Case dismissed with a written warning.
