Description

The complaint alleged James (Marty) Schafer exceeded the $5,000 mini-reporting expenditure limit and failed to disclose contributions and expenditures under full-reporting, failed to maintain contribution and expenditure details and underlying source documents in the campaign ledger and failed to include sponsor identification on mailers and doorbell hangers. 

Marty Schafer was issued a $150 civil penalty in accordance with WAC 390-37-143 (Brief Enforcement Penalty Schedule). On February 25, 2022, Schafer notified PDC staff he accepted the Statement of Understanding that included the $150 civil penalty and will send the PDC by US Mail a check and the completed SOU.

Based on this information, once the PDC receives the completed SOU and penalty payment, the matter of exceeding the mini reporting limit and failing to timely and accurately report contributions and expenditures on Monetary Contributions (C-3) and Full Summary Contributions and Expenditures (C-4) reports is dismissed in accordance with RCW 42.17A.755(1).

Pursuant to WAC 390-37-060(1)(d), Schafer was issued a formal written warning concerning violations of RCW 42.17A.320 by failing to include sponsor identification on mailers and doorbell hangers. Staff expects Schafer will, in the future, include sponsor identification on political advertising as required by law. The Commission will consider the formal written warning in deciding on further Commission action if there are future violations of PDC laws or rules. 

The PDC will not be conducting a more formal investigation into these allegations or take any further enforcement action in this matter. Based on this information, the PDC has dismissed the case in accordance with RCW 42.17A.755(1) and WAC 390-37-070.
