Description

The complaint alleged Kristen Ang, a candidate seeking election to the Port of Tacoma Commission in 2017, may have violated RCW 42.17A.235 and .240 by: (1) failing to timely file Campaign Summary Receipts and Expenditures reports (C-4), and several Monetary Contributions reports (C-3); (2) failing to provide the proper reporting breakdown for a number of expenditures made by the campaign; and (3) failing to report debts and obligations.

PDC staff reviewed the allegations; the applicable statutes, rules, and reporting requirements; the response from Kristen Ang and the C-3 and C-4 reports filed the Vote Kristin Ang campaign (Campaign). 

Staff has determined that, in this instance, the failure to timely file reports of contributions and expenditures does not amount to an actual violation warranting further investigation. As noted above, Ms. Ang was a first-time candidate for public office in 2017 and was not elected to the Port of Tacoma Commission.

Pursuant to WAC 390-37-060(1)(b), Kristin Ang received a formal written warning concerning her failure to comply with the reporting requirements as provided by RCW 42.17A.235. The formal written warning includes staff's expectation that Ms. Ang will comply with all PDC filing requirements going forward and will amend the C-4 reports listed in the complaint. The Commission will consider the formal written warning in deciding on further Commission action if there are future violations of PDC laws or rules, or if she fails to file the requested amended reports.

The PDC finds that no further action is warranted and has dismissed this matter in accordance with RCW 42.17A.755(1).
