The Public Disclosure Commission (PDC) has completed its review of the complaint
filed by Byron Debban on January 29, 2018. The complaint alleged that Tracy Moore may have violated RCW
42.17A.555 for using a city email address to support Shelton Proposition 1.
Based on our findings, staff has determined that in this instance, misuse of City facilities
to qualify Shelton Proposition 1 for the ballot, in violation of RCW 42.17 A.555, does not amount
to, a material violation warranting further investigation.
Pursuant to WAC 390-37-060(1 )(b ), Tracy Moore will receive a formal written warning
concerning her misuse of City facilities to qualify Shelton Proposition 1 for the ballot, in
violation of RCW 42.17 A.555. The formal written warning will include staffs expectation
that Tracy Moore will cease and desist from future use of public facilities to support or oppose
any election campaign. The Commission will consider the formal written warning in deciding on
further Commission action if there are future violations of PDC laws or rules.
The PDC has closed the matter, and will not be conducting a more formal investigation into the
complaint or pursuing further enforcement action in this case.
