Description

The Public Disclosure Commission (PDC) has completed its review of the complaint filed by Glen Morgan on June 20, 2018.  The complaint alleged that the American Federation of Teachers Washington Committee on Political Education PAC (AFT WA PAC) may have violated RCW 42.17A.235 by failing to accurately and timely file Monetary Contribution reports (C-3 reports) and Summary Full Campaign Contribution and Expenditure reports (C-4 reports), disclosing contribution and expenditure activities. 

PDC staff reviewed the allegations, the statutes and rules, the C-3 and C-4 reports filed by AFT WA PAC, and the July 27, 2018 July 13, 2018, response letter from Dmitri Iglitzin and Sarah Derry, two attorneys with Schwerin, Campbell, Barnard, Iglitzin & Lavitt, LLP on behalf of AFT WA PAC.

Based on these findings, and the fact that AFT WA PAC has no prior PDC violations, staff has determined that in this instance, the failure to timely file the C-3 and C-4 reports does not amount to a finding of a material violation warranting further investigation. 

Pursuant to WAC 390-37-060(1)(b), the American Federation of Teachers Washington Committee on Political Education PAC will receive a formal written warning concerning the importance of the timely disclosure of all contribution and expenditure activities, and the timely filings of all future PDC reports. The formal written warning will include staff’s expectation that AFT WA PAC file timely and complete C-3 and C-4 reports in future years in accordance with PDC laws and rules. The Commission will consider the formal written warning in deciding on further Commission action if there are future violations of PDC laws or rules.

The PDC has closed the matter, and will not be conducting a more formal investigation into the complaint or pursuing further enforcement action in this case.
