The Public Disclosure Commission (PDC) has completed its review of the complaint filed by Robert Parker on July 27, 2018. The complaint alleged that Candidate Naomi Evans may have violated RCW 42.17A.235 by failing to report a campaign-related image published in The ARC of the Peninsulas' July 2018 "Parent 2 Parent" newsletter as an in-kind contribution from the non-profit organization. This allegation gave rise to a secondary allegation that The ARC of the Peninsulas may have violated RCW 42.17A.305 by failing to report the publishing of the image as an independent, electioneering expenditure for Candidate Evans.
Based on these initial findings, staff has determined that in this instance, the unauthorized publication of Candidate Evans' photo in The ARC of the Peninsulas' July, 2018 newsletter does not amount to a violation of RCW 42.17A.235 or RCW 42.17A.305 warranting further investigation.
The PDC has closed the matter, and will not be conducting a more formal investigation into the complaint or pursuing further enforcement action in this case.
