Valentine, Micah: Alleged violations of RCW 42.17A.240 for failing to disclose an in-kind contribution or expenditure, and for failing to provide the required expenditure details for political advertisements. (EY'21; October 21)

Case

#99258

Respondent

Micah Valentine

Complainant

Richard Badalamente

Description

The complaint alleged Micah Valentine, a 2021 candidate for Kennewick School Board, violated RCW 42.17A.240 by failing to timely and accurately report expenditures and expenditure detail on Full Summary Contributions and Expenditures (C-4) reports, specifically reporting expenditures for a website created by a company owned by Valentine.

In response to the complaint, Valentine amended a C-4 covering September 1 to October 11, adding a $1,000 in-kind contribution from Ascend Marketing LLC for “website development.”

Based on these findings, the fact the website was created by the candidate with no intent to conceal the contributor, and Valentine promptly took action to comply, PDC staff has determined that, in this instance, the failure to timely and accurately report contributions does not amount to a violation warranting further investigation.

PDC staff is reminding Micah Valentine about the importance of timely and accurately filing required reports in accordance with PDC laws and rules.

Based on this information, the PDC finds that no further action is warranted and has dismissed this matter in accordance with RCW 42.17A.755(1).
