Alleged Failure to file or timely file a Candidate Registration (RCW 42.17A.205) and/or Personal Financial Affairs Statement (RCW 42.17A.700)

PDC staff has scheduled Brief Adjudicative Proceedings (Brief Enforcement hearings) for candidates that declared their candidacy for public office in 2016 and are listed in the table below, alleging violations of RCW 42.17A.205 and/or RCW 42.17A.700 by failing to file, or timely file, the Candidate Registration (C-1 report) and/or Personal Financial Affairs Statement (F-1 report) as required.

The C-1 and/or F-1 reports were due to be filed within two weeks of the candidates declaring their candidacies for public office in 2016, or not later than June 3, 2016.

As part of the 2016 Candidate Group Enforcement process, PDC staff sent out: (1) several reminder emails to all candidates in late May and early June of 2016; (2) 117 warning letters on June 30, 2016, to candidates that had not filed the missing C-1 and/or F-1 report(s); and (3) 24 hearing notices on July 21, 2016, to candidates that had not filed the missing C-1 and/or F-1 report(s).

Candidates’ names were removed from the hearing list if they completed a Statement of Understanding (SOU) acknowledging a violation of RCW 42.17A, filed the missing report, and paid a $150 penalty for each missing report, and were determined by staff after a limited review to be in apparent compliance with the PDC reporting requirements, prior to the hearing date.

The Brief Enforcement hearings are conducted in accordance with the Administrative Procedures Act (RCW 34.05), with the Commission Chair serving as the Presiding Officer.

The Commission has adopted WAC 390-37-165, which is the Candidate C-1 and F-1 Penalty schedule that will be used by the Presiding Officer to assess penalties when violations of RCW 42.17A are found at the hearings, and is attached to this document.
