  • Michael King, Senate Democratic Campaign Committee (SDCC), and The Roosevelt Fund, Case No. 13-023, involving alleged violations by:
    • Mr. King of RCW 42.17A.435 by concealing the true nature of committee expenditures, and RCW 42.17A.445 by converting committee funds to his personal use and;
    • Alleged violations by the SDCC and The Roosevelt Fund of RCW 42.17A.240 by filing inaccurate C-4 reports of campaign expenditures.

Staff reported on its investigation of allegations of concealment and personal use of contributions by Michael King and the related allegations that the Senate Democratic Campaign Committee and the Roosevelt Fund filed inaccurate disclosure reports.  After being briefed on King County’s investigation and subsequent criminal prosecution of Michael King, the Commission accepted the staff’s investigation as complete and ordered no further action on the grounds that resolution of the criminal matter adequately addresses the violations that the Commission would be pursuing.  The Commission also elected to take no further action regarding the Senate Democratic Campaign Committee or the Roosevelt Fund, provided that the parties timely file amended reports.

The Commission dismissed allegations made in a citizen action (45-day letter) that ACLU National, ACLU Washington, ACLU Washington Foundation and ACLU Washington Endowment are political committees required to register and report to the Public Disclosure Commission.  The Commission recommends that the Attorney General and county prosecuting attorneys take no further action. on the 45-day letter.

Rule Making

The Commission discussed how lobbyists disclosure entertainment expenditures and potential rule making to adjust lobbyist disclosure thresholds.  Staff was directed to solicit stakeholder comments and report back to the Commission at a future meeting.

Reporting Modifications

The Commission granted a new Personal Financial Statement (F-1) reporting modification to Senator Don Benton, 17th Legislative Dist., from disclosing business customers that paid $10,000 or more to National Advertising Consultants, Inc., or more commonly the Benton Group for 2013 and retroactively the previous four years, conditioned upon Senator Benton’s disclosing (1) all customers identified on his company’s website and in promotional materials and (2) any Washington customers that paid $10,000 or more.
