Description

PDC staff reviewed the allegation(s); the applicable statutes, rules, and reporting requirements; the response(s) provided by the Respondent; the applicable PDC reports filed by the Respondent; and other relevant information, to decide whether the record supports a finding of one or more violations.
Based on staff’s review, we found the following:

• Nancy Button is a first-time candidate running for the Position 3 School Director in Ferndale School District 502.

• Ms. Button filed a Candidate Registration (C-1 report) on May 26, 2023, choosing Full Reporting. A declaration was filed on May 19, 2023, and the original Personal Financial Affairs Statement (F-1 report) was filed on June 1, 2023, and amended August 2, 2023.

• Staff reviewed the original filed F-1 and the amended F-1 and determined real estate information, for Ms. Button’s home, was missing from the originally filed report. Once notified of the missing information, Ms. Button indicated she thought she had included the home she owns with her husband in her first report but acknowledged the information was missing.  Ms. Button amended the report upon being notified of the issue and included the required property information.

• The respondent does not have any other warnings or violations of PDC requirements.

The unreported real estate information on the F-1 appears to have been a mistake, and the issue was remedied timely. Ms. Button said in her response “my goal is to be 100% accurate.”

Based on our findings staff has determined that, in this instance, failure to promptly report real estate information on the F-1does not amount to a violation that calls for further investigation.

Per WAC 390-37-060(1)(d), however, Nancy Button will receive a formal written warning concerning her failure to ensure information on the Personal Financial Affairs Statement (F-1 report) was complete and correct at the time of filing.  PDC staff expects in the future Ms. Button will keep her information up to date according to PDC laws and rules. If violations of PDC laws or rules occur in the future, the Commission will consider this formal written warning in deciding on further Commission action.

Based on this information, the PDC finds that no further action necessary and has dismissed this matter per RCW 42.17A.755(1).
