PDC staff reviewed the allegation(s); the applicable statutes, rules, and reporting requirements; the response(s) provided by the Respondent; the applicable PDC reports filed by the Respondent; and other relevant information, to determine whether the record supports a finding of one or more violations.
Based on staff’s review, we found the following:
Ricky Anthony filed a Candidate Registration (C-1) on April 8, 2024, for the office of Governor in the State of Washington, under the Full Reporting option.
Regarding the PDC reports outlined in your complaints, staff found the following:
April contributions of $2,000 were filed on a Receipts & Expenditure Summary (C-4) report on April 14, 2024, but had to be amended a number of times until the information was accurately reported on June 14, 2024. The Cash Receipts, Monetary Contributions (C-3) report for the $2,000 in contributions was not filed until June 14, 2024. There were no expenditures in April.
The May C-4 was due June 10, 2024, and the Respondent filed a C-4 on June 10, 2024, but the information was not correct. PDC staff notified the Respondent the C-4 information was not correct, and they then filed a corrected C-4 on June 14, 2024. The C-4 shows $944.72 in receipts and $2,654.15 in expenditures. A C-3 for contributions received in May was not filed until June 14, 2024.
The C-3 #110222639, for period 6/21/24, showed a contribution received in May, and the C-4, #110224932, for the period 06/01/24-06/30/24 and filed on June 27, 2024, showed the contribution received in May. The Respondent amended these reports on June 29, 2024.
All reports between April and May 2024, were filed late.
Through June, contributions are $3,194.72 and expenditures are $3,026.95.
The Respondent does not have other similar warnings or violations of PDC requirements.
Based on our findings staff has determined that, in this instance, failing to file timely and accurate contribution and expenditure reports for the period of April through May 2024 does not appear to be a violation that calls for further investigation.
Per WAC 390-37-060(1)(d), however, Ricky Anthony will receive a formal written warning concerning the requirement under RCW 42.17A.235 and RCW 42.17A.240 for failing to timely and accurately file contribution and expenditure reports. Staff expects Ricky Anthony, moving forward, to follow all laws, rules and PDC guidance about timely and accurate reporting of contributions and expenditures. If violations of PDC laws or rules occur in the future, the Commission will consider this formal written warning in deciding on further Commission action.
Based on this information, the PDC finds that no further action necessary and has dismissed this matter per RCW 42.17A.755(1).
