Description

This case alleged a violation of RCW 42.17A.235 & .240 for failure to timely & accurately disclose sign printing costs and 4/13/23 pizza for Ardor Printing as expenditures and/or in-kind contributions on C-4 reports.

PDC staff reviewed the allegations and evidence submitted; the applicable statutes, rules, and reporting requirements; the responses provided by Adam Fortney (the “Respondent”); the applicable PDC reports filed by the Respondent; and other relevant information; and queried the Respondent’s data in the PDC contribution and expenditure database, to determine whether the record supports a finding of one or more violations.

Based on the attached findings, PDC staff has determined that, in this instance, failure to timely report contributions and expenditures on reports does not amount to a violation that warrants further investigation.

Pursuant to WAC 390-37-060(1)(d), however, Adam Fortney received a formal written warning concerning his failure to timely disclose contributions, in-kind contributions, and expenditures made to the campaign. The formal written warning included staff’s expectation that Adam Fortney timely and accurately disclose contributions, in-kind contributions, and expenditures on C-4 reports in the future. The Commission will consider the formal written warning in deciding on further Commission action if there are future violations of PDC laws or rules.

Based on this information, the PDC finds that no further action is warranted and has dismissed this matter in accordance with RCW 42.17A.755(1).
