On October 13, 2023, the Public Disclosure Commission received a complaint alleging that Richard Emery (Respondent), a candidate for City Council Member, Position 4, in the City of Mukilteo, may have violated RCW 42.17A.235 and .240 for failure to timely and accurately file contribution and expenditure reports, as required by law.
PDC staff reviewed the allegations/complaint and determined that the Respondent failed to timely file some contribution and expenditures reports. As a candidate registered with the PDC under the Full Reporting option, the Respondent was required to file timely C-3 and C-4 reports, including the 21—Day pre-general C-4 report for a candidate who appeared in the general election in the 2023 election year. However, staff did note that the Respondent inadvertently selected the “Full Reporting” instead of “Mini Reporting” option when he originally filed his Candidate Registration (C-1 report) with the PDC.
Based on the staff’s review, this complaint was resolved through a formal warning letter to the Respondent.
Accordingly, the PDC dismissed this matter in accordance with RCW 42.17A.755(1).
