Tela Hogle: Alleged violation of RCW 42.17A.235 and .240 for failure to timely and accurately report contributions on reports. (EY24 JUL24)

Description

Based on staff’s review, we found the following:

• Tela Hogle filed a Candidate Registration declaring their candidacy for State Senate in Legislative District 22, selecting the Full Reporting Option.

• A complaint was filed alleging a total of two late filed C-3 (contribution) reports, and one C-4 (expenditure) report with a lack of required detail for an in-kind purchase, as required by WAC 390-16-037.

• RCW 42.17A.235 describes the required filing deadlines for disclosure of campaign finance activities including monetary contributions.

• RCW 42.17A.240 requires committees to file accurate campaign finance reports with the Public Disclosure Commission.

• The campaign has filed 32 contribution reports totaling $5,718.55, for the 2024 election cycle. A small number of the contribution reports were filed at most 28 days late, for a combined total of $200 dollars.

• The campaign stated that the expenditure identified in the complaint was a purchase of thank you cards that were not for the purposes of political advertising and as such did not require further details.

• The Respondent stated they appreciate the opportunity to learn, and make necessary corrections and will continue to strive to meet every deadline.


Based on this information, the PDC finds that no further action is warranted and has dismissed this matter in accordance with RCW 42.17A.755(1).

Pursuant to WAC 390-37-060(1)(d), however, Tela Hogle will receive a formal written warning concerning failure to timely disclosure of all contribution and expenditures. The formal written warning will include staff’s expectation that Tela Hogle timely files all future required reports of contributions and expenditures. The Commission will consider the formal written warning in deciding on further Commission action if there are future violations of PDC laws or rules.
