Allegation: Violation of RCW 42.17A.235 and .240 for failure to timely and accurately report contributions on reports
Based on staff’s review, we found the following:
Randy Agnew filed a Candidate Registration declaring their candidacy for County Commissioner in Douglas County, selecting the Full Reporting Option.
Two separate complaints were filed alleging a total of two late filed C-3 (contribution) reports, and one late filed C-4 (expenditure) report with a lack of required detail for political advertising, as required by WAC 390-16-037.
RCW 42.17A.235 describes the required filing deadlines for disclosure of campaign finance activities including monetary contributions.
RCW 42.17A.240 requires committees to file accurate campaign finance reports with the Public Disclosure Commission.
WAC 390-16-037 includes directions on disclosing expenditures made for certain types of political advertisements and includes an example of the expected detail.
The campaign has filed 17 contribution reports totaling $18,946.80, for the 2024 election cycle. A small number of the contribution reports were filed between 32 and 37 days late, for a combined total of $4,200 dollars.
The campaign amended the expenditure report to include the quantity of yard signs purchased for political advertising once notified.
The Respondent stated they strive to follow all PDC requirements and will work to correct any mistakes as promptly as possible.
Based on this information, the PDC finds that no further action is warranted and has dismissed this matter in accordance with RCW 42.17A.755(1).
Pursuant to WAC 390-37-060(1)(d), however, Randy Agnew will receive a formal written warning concerning failure to timely disclosure of all contribution and expenditures. The formal written warning will include staff’s expectation that Randy Agnew timely files all future required reports of contributions and expenditures. The Commission will consider the formal written warning in deciding on further Commission action if there are future violations of PDC laws or rules.
