Marc Doney: Alleged violation of RCW 42.17A.235 & .240 for failure to timely and accurately report contributions & expenditures (EY24 OCT24)

Description

Based on staff’s review, we found the following: 

  • Marc Doney (the Respondent) filed a Candidate Registration declaring their 2024, candidacy for County Commissioner in Okanogan County, selecting the Full Reporting Option.  
  • Complaints were filed alleging late filed C-3 (contribution) Reports, failure to disclose the filing fee, failure to include run dates for political advertising in the 2024 election cycle and failure to file the post general C-4 Report. 
  •  RCW 42.17A.235 describes the required filing deadlines for disclosure of campaign finance activities including monetary contributions. 
  •  RCW 42.17A.240 requires committees to file accurate campaign finance reports with the Public Disclosure Commission.  
  •  WAC 390-16-037 includes directions on disclosing expenditures made for certain types of political advertisements and includes an example of the expected detail. 
  •  Marc Doney filed C-3 (contribution) Reports with incorrect receipt dates but corrected the information and submitted amendments once notified. 
  •  Several C-3 (contribution) Reports were filed late, totaling $550 dollars out of $9,048.72 of total cash and in-kind contributions raised during the campaign. 
  •  The campaign amended reports to include run dates and filing fee once notified. 
  •  The Respondent filed the post general C-4 Report five days late, disclosing $840 in radio and newspaper ads.    

 Based on this information, the PDC finds that no further action is warranted and has dismissed this matter in accordance with RCW 42.17A.755(1)

Pursuant to WAC 390-37-060(1)(d), however, Marc Doney will receive a formal written warning concerning failure to timely disclosure of all contribution and expenditures. The formal written warning will include staff’s expectation that Marc Doney timely and accurately files all future required reports of contributions and expenditures. The Commission will consider the formal written warning in deciding on further Commission action if there are future violations of PDC laws or rules. 

 Furthermore, any allegations regarding reporting by you for the 2024 campaign that are not otherwise addressed are hereby dismissed.
