This complaint alleged that Tim Probst may have violated RCW 42.17A.235, .240, .205, .700, .430, .425, .220, .320 and .405 for failure to accurately and timely file C-3 and C-4 reports and report debt; properly break down expenses and list committee officers; and for unauthorized expenditure of funds by non-committee officers; and for not preserving books of account or certifying contribution and expenditure reports; and for unauthorized deposit of campaign funds by a non-treasurer; for failure to include sponsor ID and timely submit an F-1 statement; for donation of campaign funds to an unauthorized entity; and failure to refund contributions that exceed contribution limits.
The allegations in this complaint were substantially similar to a citizen action complaint filed with the Attorney General's Office pursuant to RCW 42.17A.765. On April 13, 2018, the PDC became aware that a lawsuit containing substantially similar allegations was filed in Superior Court in the name of Washington State, giving the Superior Court primary jurisdiction over the substance of the complaint; the PDC deferred to their judgment in bringing the issues to resolution.
The PDC dismissed this matter and did not conduct a more formal investigation into this complaint or pursue further enforcement action in this case.
