Description
The Public Disclosure Commission (PDC) has completed its review of the complaint filed by Dmitri Iglitzin on January 30, 2018. The complaint alleged that that Liz Pike, an incumbent State Representative from the 18th Legislative District and a candidate seeking re-election to that office in 2016, may have violated RCW 42.17A.235 and .240 by failing to timely file Summary Campaign Contribution and Expenditure reports (C-4 reports) disclosing contribution and expenditure activities undertaken by her 2016 campaign.
While the 21-Day Pre-General Election C-4 report was not alleged in the complaint, staff believes the report was the most critical of the late filed C-4 reports since it contained time sensitive contribution and expenditure information after the ballots had already been mailed out, and prior to the November 8, 2016 general election date. The late filed C-4 reports are mitigated by the fact the Campaign timely filed all Monetary Contributions reports (C-3 reports) for the 2016 election cycle, with many of the C-3 reports being filed electronically on the same day the contributions had been received and deposited.
Based on our findings, staff has determined that in this instance, failure to timely file the C-4 reports of contributions and expenditures referenced above, does not amount to a material violation warranting further investigation.
Pursuant to WAC 390-37-060(1 )(b), Liz Pike will receive a formal written warning concerning failure to timely file C-4 reports as provided in RCW 42.l 7A.235. The formal written warning will include staffs expectation that Liz Pike timely files C-4 reports during 2018 for her candidacy for Clark County Council, and any future campaigns in accordance with PDC laws and rules. The Commission will consider the formal written warning in deciding on further Commission action if there are future violations of PDC laws or rules.
The PDC has closed the matter, and will not be conducting a more formal investigation into the complaint or pursuing further enforcement action in this case.
