Report to Commission re: Grocery Manufacturers Association (GMA), Case No. 14-002, a 45-day citizen action complaint involving alleged violations of RCW 42.17A.205, .235 and .240 by failing to register and report as a political committee in opposition to I-522, a statewide initiative on the November 5, 2013 general election ballot concerning the mandatory labeling of genetically modified organisms (GMOs) in certain food and beverages.

Reconsideration of Final Commission Order re: Robert Jesse Hill, Case No. 13-126, involving violations of RCW 42.17A.205 and .700 by failing to file a Candidate Registration (C-1 report) and a Personal Financial Affairs Statement (F-1 report) as a 2013 candidate for Tacoma City Council.

William Neal, General Manager, North Beach Water District (NBWD), Case No. 13-002, involving alleged violations of RCW 42.17A.555 by authorizing one of his subordinates, Tami Herman, a NBWD staff person when the alleged violations occurred, to use the NBWD facilities (computer and copier) to assist the 2012 campaign of William Herman, Ms. Herman’s spouse, for Pacific County Commissioner.

The Commission may deliberate in closed session on any enforcement matter on this agenda, or any matters listed in RCW 42.30.140.

Chair Ranade announced Governor Inslee’s appointment of a new commissioner, Katrina Asay. 

Asay is a former state representative from the 30th legislative district (representing part of King & Pierce Counties, including Federal Way, Des Moines, Milton, Algona and Pacific, and part of Auburn).

Her term begins February 3, 2014 - expires 2017.

Rule Making

The Commission continued its discussion on Lobbyist reporting of entertainment, food and beverages. Staff reported to the Commission that related legislation may be introduced during the 2014 session.

The Commission indicated that they want to consider adjusting  the thresholds as well as consider alternative reporting for receptions. The Commission will wait to see whether Legislative changes are made in 2014 before taking further action.

The Staff was directed to proceed with expedited rule making to add online access information to agency forms.

Filer Requests

The Commission granted a new Personal Financial Statement (F-1) reporting modification to Richard L. Anderson, City Council Member, and City of Everett. Exempting him from disclosing the business customer that paid $10,000 or more in the previous 12-months to Hascal, Sjoholm and Company PLLC- Certified Public Accountants.

The Commission granted a one-time temporary electronic filing waiver to Senator Pam Roach, 2014 Candidate for State Senate from the 31st Legislative District, provided that the campaign electronically file, no later than March 10, 2014, all required C-3 and C-4 reports disclosing contributions and expenditures from October 2013 through February 2014.

Enforcement

Grocery Manufacturers Association (GMA)

The Commission accepted the staff recommendation and took no further action concerning the citizen action (45-day letter) complaint involving alleged violations of RCW 42.17A.205, .235 and .240 by failing to register and report as a political committee in opposition to I-522, a statewide initiative on the November 5, 2013 general election ballot concerning the mandatory labeling of genetically modified organisms in certain foods.

Robert Jesse Hill

The Commission denied the reconsideration of The November 5, 2013 Final Order for Robert Jesse Hill, Case No.13-126, involving violations of RCW 42.17A.205 and .700 by failing to file a Candidate Registration (C-1 report) and a Personal Financial Affairs Statement (F-1 report) as a 2013 candidate for Tacoma City Council.

As of January 22, 2014 Mr. Hill has not filed the required missing reports.

William Neal, General Manager, North Beach Water District (NBWD)

The Commission accepted the Stipulation as to Facts, Violation and Penalty as presented regarding alleged violations of RCW 42.17A.555 by authorizing one of  his subordinates, Tami Herman, a NBWD staff person when the alleged violations occurred, to use the  NBWD facilities (computer and copier) to assist the  2012 campaign of William Herman, Ms. Herman’s  spouse, for Pacific County Commissioner.

A penalty of $750 was assessed, with $500 suspended.
